Introduction

We are Ogma Therapy Ltd (Ogma, we, us and our). We provide access to Speech and Language Therapy services (SLT) to children via our website and app (Services).Our Services apply a “data protection by default” and “data protection by design” approach in keeping with the principle of minimising the processing of personal data to the extent necessary to provide the Services and to further develop and enhance our Services.

How do you use my data?

  • To provide you with updates about our Service and notify you of changes to our Service, Policies or Terms, we will use your name and email address to send you updates about Ogma because we have a legal, regulatory or other requirement to contact you about changes.
  • To send you marketing information. Where you have previously expressed an interest in our Services (and not opted-out of marketing) we will use your name and email address to send you updates about Ogma because it is in our legitimate interests to promote our other products and Services we think you might be interested in.

    Where you are a new customer and have opted in via our website to receive updates on our products and Services including offers, promotions and new options, we will process your personal data to provide you these updates in line with the preferences you have provided and will only use your personal information in this way with your consent.

    You can withdraw your consent to marketing at any time by contacting us at info@ogmatherapy.com or, where relevant, by following the unsubscribe link in any marketing communication you receive from us.
  • When you contact us either by phone, email, via our 'contact us' page or via social media, we will usually collect your name, social media handle, contact details, and information relating to your query, because it’s in our legitimate interest to make sure we can properly respond to your query.
  • When you use our website or app and consent to our use of non-essential cookies we will collect information about how you use our website and app. We use this information to better understand how people use our website and app, and to improve our services.   • When you apply for a job with us we may collect your name, contact details, recruitment information (e.g. right to work documentation and references), test results (inc. psychometric), qualifications, accreditations and any additional information we may receive from you or our recruitment partners.

    We will use your personal data to assess your suitability for our available roles. We do this to perform our contract obligations or to take steps at your request, before entering into a contract. Where we process your right to work documentation, we will do so to comply with our legal obligations.
  • If our business is sold. We may process your personal data for this purpose because we have a legitimate interest to ensure our business can be continued by the buyer. If you object to our use of your personal data in this way, the buyer of our business may not be able to provide Services to you.

Platform Users

  • When you register interest in Ogma Therapy services, we collect your name, email address, phone number, child's name, child's date of birth, child's postcode, history of SLT from medical and school records, languages spoken at home, child interests and routines, and payment information (such as the payment provider's address). We collect this in order to take steps to enter into a contract with you and allow you to purchase our Services on our website or app.
  • When we provide SLT to you or your child via our Service we may, with your consent:

    (a) collect data about the SLT provided so that our therapists can tailor the SLT to your child and use our Services to provide reports to you and any relevant third party (such as a school or medical provider) about the progress of your child's SLT; 

    (b) collect, store and use audio recordings of the SLT sessions in order to provide and maintain our Services;

    (c) and process the data collected in the audio recordings to      perform, test or improve our speech recognition technology and artificial intelligence algorithms, or for other research and development and data analysis purposes. These recordings may be listened to by human ears for the specific purpose of generating transcriptions or labelling data. 
  • If you choose to provide responses to our diversity and inclusion questions we will collect data about your household's socio-economic status, ethnicity, and accent. We collect this information with your consent so that we can look to improve access to our Services. You do not need to provide this information and if you choose not to, it will not impact your experience of our SLT Services.

Therapists:

  • When you create and log into an Ogma Assistant account (www.assistant.ogmatherapy.com) we will collect your full name, email address, phone number, practice name, practice specialism, age specialism, therapy delivery method (e.g. in person, Zoom, etc.), and work setting (private, NHS, etc.).

Children:

  • We rely on consent from an individual with parental responsibility as the legal basis for processing personal data where we are required by law to rely on consent and the data subject is a child. We have our own clear parental consent mechanisms and verification processes in place and you can withdraw your consent as outlined below (What are my rights and my child's rights under data protection law?). 

    We respect the role of those with parental responsibility in the monitoring of their children’s online activities. Accordingly, we limit our collection of personal data from children to no more than is reasonably necessary to participate in the Services and to improve the Services. We do not collect any personal data from children other than as set out in this policy. 

Who do you share my data with?

  • Business partners, suppliers and subcontractors for the performance of the contract we enter into with them or you. 
  • Therapists, Advisors and other SLT Service Providers so that they can provide your child with SLT and tailor their sessions to you.
  • Regulators/ Authorities/ Enforcement Agencies if we are under a duty to disclose or share your personal data in order to comply with any legal obligation, or in order to enforce or apply our terms of use and other agreements; or to protect the rights, property, or safety of our customers or others. This includes exchanging information with other companies and organisations for the purposes of fraud protection.
  • Prospective buyers of our business under our legitimate interest to ensure our business can be continued by the buyer.

Where do you store my data?

We store your data on  third party servers which are based both in the UK and in the EU.

When working with third parties we may need to transfer your personal data outside of the UK and / or EU.Whenever we transfer your personal information outside of the UK and the EU, we ensure it receives additional protection as required by law.

If you are accessing our Services via a third party provider (such as an NHS trust or other medical or educational service), you should also contact your third party provider to request to exercise your rights over the personal data they may hold.

Please keep in mind that privacy law is complicated, and these rights will not always be available to you all of the time.
